  1. About the Website
    1. Welcome to youdolaw.com.au (the 'Website'). The Website provides for self-help legal divorce documents (the “Product” is what is generated through the use of the Website and any other capabilities we offer will be deemed "Services").
    2. The Website is operated by Youdolaw Pty Ltd (ACN 665 248 055) as trustee for the Youdolaw Unit Trust ABN (97 684 405 830) ("we," "us," "our," or "Youdolaw")(ABN ). 
    3. Access to and use of the Website, or any of its associated Products or Services, is provided by Youdolaw. Please read these terms and conditions (the 'Terms') carefully. 
    4. By using or browsing the Website, you confirm that you have read, understood and consent to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of Services, immediately.
    5. Youdolaw reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Youdolaw updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records.
    6. Please be aware that the Product and/or Services Youdolaw provides are not legal advice, unless otherwise specified in the product. Youdolaw is not a law firm. You must obtain independent legal advice regarding the Divorce Document (or any Product or Services) that you generate using the Website. 
    7. Our Website does not cater to, or sell Services, for those individuals who wish to prepare their Divorce Document in Western Australia. 
  2. Restraints 
    1. Youdolaw has the right to refuse to provide our Services, including the information of any Divorce Document that our Website provides, to any person or entity at our sole discretion, and we reserve the right to amend our eligibility requirements at any time. 
    2. The Divorce Document and Services that we provide, which you order and purchase from us, are for your personal use exclusively and are not meant for the use or profit of anyone else. In the event that Youdolaw is aware that you have used the Services or Divorce Document purchased for any other purpose, Youdolaw reserves the right to immediately cancel your order and registration, without notice to you.
  3. Acceptance of the Terms
    1. You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by Youdolaw in the user interface.
    2. When Youdolaw processes your order and payment, in full, has been made by you and received by Youdolaw. Acceptance of your order for your Divorce Document or any other Services that you have purchased from our Website will take place. It is at this time, that a contract will come into existence between you and Youdolaw.
  4. Registration to use the Services
    1. In order to access the Services, you must first register for an account through the Website (the 'Account').
    2. As part of the registration process, or as part of your continued use of the Services, you may be required to provide personal information about yourself (such as identification or contact details), including:
      1. Email address
      2. Password
      3. Information to you, your former spouse, your children and any other party relevant to your Divorce Document (for example, a translator, family member or friend). This information includes but is not limited to:
        1. full name;
        2. country of birth;
        3. occupation;
        4. residential address and/or address for service;
        5. citizenship status and any related supporting document;
        6. information contained in a marriage certificate and/or change of name certificate;
        7. court documents relating to your divorce application such as Court Orders, Financial Agreements, Intervention Orders, Parenting plans;
        8. date of separation and other personal details regarding the separation, including but not limited to, period living under the same roof, reconciliation, child support, finances (for example daily living expenses and income), intimacy, lifestyle; and
        9. any and all other relevant information that we require you to provide regarding your divorce application to enable you to use our Services. 
    3. You warrant that any information you give to Youdolaw in the course of completing the registration process and purchasing the Divorce Document will always be accurate, correct and up to date.
    4. Once you have completed the registration process, you will be a registered member of the Website ('Member').
    5. You may not use the Services and may not accept the Terms if:
      1. you are not of legal age (eighteen (18) years old) to form a binding contract with Youdolaw; or
      2. you are a person barred from receiving the Services under the laws of Australia or other countries including the country in which you are resident or from which you use the Services.
    6. When using our Services or making any purchase whatsoever from our Website, you represent and warrant to Youdolaw that you are over the age of eighteen (18). Youdolaw reserves the right to seek compensation from the minor's parents or guardians if Youdolaw suffers any damage or other losses as a result of a transaction engaged into by that minor.
  5. Divorce Document
    1. ‘Divorce Document’ includes, but is not limited to the following documents generated through the Youdolaw Website, namely:
      1. The “do it yourself” media provided on our Website teaching you how to complete the divorce application yourself and all other related content regarding the divorce application process; and
      2. the following Court document templates:
        1. Response to Divorce Application;
        2. Affidavit of Service (by hand/process server);
        3. Affidavit of Service (by post);
        4. Affidavit (living under the same roof);
        5. Corroborating Affidavit (living under the same roof);
        6. Affidavit – translation of marriage certificate;Affidavit – proof of signature;
        7. Application for reduction of Court filing fee – general;
        8. Application for reduction of Court filing fee – financial hardship; 
        9. Affidavit – Translation of Marriage Certificate;
        10. Affidavit – Proof of Signature; and
        11. any other Court document templates that are sold on our Website. 
    2. Youdolaw, this Website, the Services (including Third Party Services) or Products sold, are established only to educate and provide you with information to help you in preparing your Divorce Document yourself. 
    3. It is entirely up to the user to watch, read and understand the information provided by Youdolaw on this Website. 
    4. Youdolaw does not take any responsibility for the user not understanding or being able to implement the educational information provided.   
    5. When using the Youdolaw platform to generate a Divorce Document, please be aware, that Youdolaw does not review any Divorce Document created and submitted on the Youdolaw platform. It is up to the user to ensure that the document is true, correct and accurate prior to swearing/affirming it and filing it with the Court.  
    6. When using the Youdolaw platform to create a Divorce Document, Youdolaw relies on the information input by the user into the Youdolaw platform and assumes that this information correctly corresponds to the questions being asked of the user throughout the digital flow.
    7. Please be aware that Youdolaw will not, at any point during the generation of your Divorce Document, review or confirm the information submitted by you for accuracy. 
    8. Youdolaw will not review or verify: 
      1. the accuracy of any person, name, address including the general content of the information supplied by you and provided in the digital flow for the purposes of your Divorce Document; 
      2. the nature and accuracy of information included in your Divorce Document regarding your individual circumstances regarding your divorce and separation, including the identity or age of people included in your Divorce Document; and/or
      3. the existence, description or location of supporting documentation that you wish to describe in your Divorce Document.
    9. Additionally, Youdolaw will not consider your specific personal circumstances when preparing your Divorce Document, based on the information that you have input into the digital flow. 
    10. Youdolaw may engage a law firm for the purposes of quality control of the digital process, at its own discretion Law Firm. 
    11. If Youdolaw considers it is appropriate to do so, Youdolaw may, at its absolute discretion, contact you to request further information for accuracy, otherwise that section of the Divorce Document will be left blank for the user to complete themselves.  
    12. Youdolaw does not provide any opinion or advice whatsoever on the contents of your Divorce Document as it applies to your personal circumstances when generating your Divorce Document. 
    13. You acknowledge and agree that you will be solely responsible for attending to and seeking advice on those matters if required.
  6. Divorce Document Review Process
    1. As part of its quality assurance process, Youdolaw engages an Australian law firm ("the Law Firm") to review each Divorce Document created and submitted on the Youdolaw Platform. 
    2. This review is procedural in nature, to ensure that the information input by the user into the Youdolaw platform correctly corresponds to the questions being asked of the user throughout the digital flow. 
    3. In conducting the review, both Youdolaw and the Law Firm relies on the accuracy of the information provided by you. At no point during the review will Youdolaw or the Law Firm review or confirm the information submitted by you for accuracy. For example, Youdolaw or the Law Firm will not review or verify:
      1. the accuracy of any name mentioned in the Divorce Document;
      2. the accuracy of any address mentioned in the Document;
      3. the nature of your personal family arrangements, including the identity or age of people included in your family; the existence, description or location of your assets, including superannuation;
      4. the information provided by you regarding your children, and your relationship; 
      5. the existence or description of any entity, company, trust or other structure. 
    4. Additionally, the Law Firm will not consider your specific personal circumstances in conducting the Divorce Document review. 
    5. The Law Firm is engaged by Youdolaw to provide quality control on the Youdolaw digital process and communications made by Youdolaw only. 
    6. In using the youdolaw platform, you acknowledge that there is no lawyer client relationship formed between you and the Law Firm. Neither Youdolaw or the Law Firm provides any opinion or advice whatsoever on the contents of your Divorce Document as it applies to your personal circumstances when conducting the review. The review will under no circumstances assess:
      1. validity of any and all information in your Divorce Document;
      2. requirement to properly serve your former spouse;
      3. requirement to properly have your Divorce Document witnessed;
      4. requirement to properly file your Divorce Document; 
      5. easibility of the information expressed in your Divorce Document; and
      6. the information provided by you regarding your children, and your relationship; and 
      7. you acknowledge and agree that you will be solely responsible for attending to and seeking advice on these matters if required.
  7. Your obligations as a Member
    1. As a Member, you agree to comply with the following:
      1. you will use the Services only for purposes that are permitted by:
        1. the Terms; and
        2. any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions;
      2. you have the sole responsibility for protecting the confidentiality of your password and/or email address. Use of your password by any other person may result in the immediate cancellation of the Services;
      3. any use of your registration information by any other person, or third parties, is strictly prohibited. You agree to immediately notify Youdolaw of any unauthorised use of your password or email address or any breach of security of which you have become aware;
      4. access and use of the Website is limited, non-transferable and allows for the sole use of the Website by you for the purposes of Youdolaw providing the Services;
      5. you will not use the Products/Services or the Website in connection with any commercial endeavours except those that are specifically endorsed or approved by the management of Youdolaw;
      6. you will not use the Products/Services or Website for any illegal and/or unauthorised use which includes collecting email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorised framing of or linking to the Website;
      7. you agree that commercial advertisements, affiliate links, and other forms of solicitation may be removed from the Website without notice and may result in termination of the Products/Services. Appropriate legal action will be taken by Youdolaw for any illegal or unauthorised use of the Website; and
      8. you acknowledge and agree that any automated use of the Website or its Products/Services is prohibited.
    2. Youdolaw shall be entitled to securely and safely store your Account details on the data platform of its choosing.
    3. You represent and warrant to Youdolaw that all information provided to Youdolaw by you, including the information provided by you through our account registration process, not misleading, true and correct, and does not violate any applicable law or regulation or any person's intellectual property or other rights.You must ensure that all of the information provided to Youdolaw is correct and accurate at all times and is updated accordingly when necessary. 
    4. One person may not hold more than one account with this Website. 
    5. Accounts registered by "bots" or other automated methods are not permitted. Youdolaw reserves the right to accept or reject any application for registration of an Account with this Website at its discretion.
    6. You agree that Youdolaw has the right to presume that anyone using your login and password on this Website is you. 
    7. Any known or suspected unauthorised use of a password, or any other security breach, must be reported promptly to youdolaw by you.
  8. Acknowledgements
    1. Before registering an Account with us, or placing an order through our Website, you acknowledge and agree that:
      1. You meet all legal requirements to make a Divorce Document in the State or Territory in which you reside, including: 
        1. that you are eighteen (18) years old or older; 
        2. you are capable of entering into a legally binding document;
        3. you have carefully and properly reviewed the Products/Services  we offer; 
        4. you are physically and mentally capable of making and ordering the Products/Services from Youdolaw; 
        5. and you have reviewed these Terms. 
    2. You acknowledge and agree that:
      1. you are solely responsible for the creation and content of your Divorce Document;
      2. you are solely responsible for ensuring that your Divorce Document is properly executed by you in the presence of the appropriate witnesses;
      3. you are solely responsible for ensuring that your Divorce Document is properly filed with the Federal Circuit and Family Court of Australia at the appropriate location in your State;
      4. you are solely responsible for ensuring that your Divorce Document is properly served on you former spouse;
      5. you are solely responsible for ensuring that your Divorce Document is properly translated (if necessary); 
      6. you are solely responsible for all of the relevant supporting documentation you are required to provide with your Divorce Document;
      7. you are solely responsible for applying your own understanding and determining whether or not you will be eligible for a Court filing fee reduction;
      8. the Divorce Document and other Services offered via our Website are suitable for divorce in Australia only. We recommend engaging an Australian Legal Practitioner for specific advice regarding your divorce, property or parenting settlement. If you are not eligible to divorce in Australia or create the Divorce Document in Australia, and you continue to engage our Services, Youdolaw shall bear no responsibility and assume no liability for the consequences of your actions and the potential ineffectiveness of your Divorce Document in respect to those assets.
  9. Orders
    1. By placing an order through this Website, you make an irrevocable offer to Youdolaw to purchase your Divorce Document and the Products/Services that you have selected pursuant to these Terms.
    2. The information contained in the Website constitutes an invitation to treat only. 
    3. No information in our Website constitutes an offer by us to supply any Products/Services to you – however, Youdolaw will strive to provide the Products/Services to you.
    4. Please be aware that unless and until:
      1. we have received full payment for the order; and
      2. the order has passed our internal validation procedures, which are undertaken in order to verify the validity of each order (to ensure the prevention of credit card and other fraud), we will not commence processing any order made through this Website.
    5. Once you have provided Youdolaw with the information for your Divorce Document or any other Products/Services that we provide and you have received your order, you will be unable update or modify your Divorce Document or the information provided to us for any other Services that you have ordered. 
    6. Youdolaw reserves the right, at our sole discretion, to:
      1. cancel, all or part of, your order at any time prior to your order being accepted in accordance with these Terms, and
      2. at any time:
        1. refuse to provide any and all of our Products/Services to you (including your Divorce Document);
        2. terminate your access to our Website; and/or remove or edit any content on our Website.
  10. Prices & Discounts
    1. Youdolaw reserves the right to change any and all prices shown on our Website at any time before you place an order, and that order is processed by us. 
    2. We will notify you in advance of any pricing changes that may affect future orders.
    3. Where any discounts and/or offers have been made available by Youdolaw from time to time, you shall be entitled to use such discounts/offers to purchase your Divorce Document or any other Products/Services available on our Website in accordance with these Terms or as otherwise directed on our Website. 
    4. Only one discount code can be used per transaction. Discounts may be applied to the cost of a Divorce Document only. The total price for your Divorce Document and any other Products/Services ordered by you are displayed on our Website. 
    5. Your Divorce Document and any other Products/Services we offer will only become available for download and/or use once payment has been made in full and received by us.
    6. For the purposes of these Terms, "GST" has the meaning given to it in the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Unless we have specifically detailed otherwise, all amounts due and payable through your use of our Website are expressed to be inclusive of GST. 
  11. Payment
    1. Where the option is given to you, you may make payment  of the fee for the Products and/or Services (the 'Services Fee') by way of:
      1. Credit Card Payment ('Credit Card') (we are currently only accepting Via and Mastercard as payment methods);
      2. Google Pay (‘GPay’); and
      3. PayPal ('PayPal') (if activated).
    2. All payments made in the course of your use of the Services are made using Stripe. In using the Website, the Services or when making any payment in relation to your use of the Services, you warrant that you have read, understood and agree to be bound by the Stripe terms and conditions which are available on their website.
    3. You acknowledge and agree that where a request for the payment of the Services Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Services Fee.
    4. You agree and acknowledge that Youdolaw can vary the Services Fee at any time and that the varied Service Fee will come into effect immediately.
    5. Unless you expressly consent otherwise, we do not see or have access to any personal information that you may provide to Stripe, other than information that is required in order to process your order (e.g., your name, email address and billing/postal address).
    6. Youdolaw does not accept any responsibility for any errors made by Stripe. By providing your credit or debit card details, you confirm that you are authorised to use that payment method, and you authorise Youdolaw, through the Stripe to charge your payment method for the total amount of your order.
    7. We shall not be responsible for any delays to your order in the event that your credit or debit card is declined for any reason whatsoever and it is your responsibility to ensure your credit or debit card details are up to date.
    8. While Stripe, our Website hosting providers, and any other third party providers employ secure technology for transactions with our users, we will not be responsible for any damages, including Consequential Loss (whether direct or indirect), that may be suffered by a customer/user whose credit or debit card, bank account information or personal information is used in a fraudulent or unauthorised manner by any person other than Youdolaw. Youdolaw may request further information from you, such as a copy of your credit card and/or other identification documentation, as part of our internal validation procedures. These procedures help bank and credit card account holders from online fraud and may be used to verify that you are in fact the person the subject of the Services and/or Divorce Document that is being created.
    9. If further information is requested and you do not provide the requested information within such time as Youdolaw considers appropriate at its discretion, your order will be cancelled and, if your payment has been received, it will be refunded back to you.
  12. Refund Policy & Cancellation
    1. You acknowledge and agree that you will not be entitled to cancel your order once it has been accepted by us. Further, if for whatever reason, you choose not to use, sign and/or file your Divorce Document or any other Service provided by us once it has been purchased from our Website, you acknowledge and agree that you will not be refunded the purchase price of for your Divorce Document or the Service which you have purchased (either singular or plural, depending on your order). 
    2. Youdolaw may, at its absolute discretion, continue to hold your Stored Information (in accordance with our Privacy Policy) for the period that you hold your Account or until you request, in writing, that your Account be deleted by us.
    3. Youdolaw may, at its absolute discretion, permanently delete your Stored Information without notice to you.
    4. Except as expressly provided otherwise in these Terms all amounts paid through this Website are non-refundable. Nothing in this section affects your statutory rights as a consumer.
    5. Youdolaw will only provide you with a refund of the Services Fee (including any Service Fee) provided by us (including the Divorce Document) if Youdolaw makes a decision, at its absolute discretion, that it is reasonable to do so under the circumstances. Where this occurs, the refund will be in the proportional amount of the Services Fee that remains unused by the Member (the 'Refund').
  13. Third Parties
    1. Youdolaw will:
      1. sell services through our Website which are supplied by other parties; and
      2. any other third party provider and/or service that we use to enable use to provide our Services or sell any products to you, including but not limited to third parties with external data centres, such as Google Analytics, Microsoft Azure, Amazon Web Services, Apple, Typeform etc., and online relationship management tools (collectively referred to as "Third Parties"). 
    2. The Third Parties may from time to time provide services that include but are not limited to the following:
      1. Process Servers;
      2. Psychology;
      3. Legal Services; and
      4. Any other services or products detailed on our Website which have been expressly stated as a third party service or which we use to supply the our Services or sell our products on our Website (collectively referred to as "Third Party Services").
    3. Third Party Services and Privacy:
      1. When you purchase the Third Party Services through our Website, you may be required to provide Youdolaw with copies of documents and/or personal information to complete that purchase (as outlined above). 
      2. As part of that purchase, Youdolaw may be required to provide those documents and/or personal information to those third parties to enable them to complete the Third Party Service. In making the purchase you expressly consent to that information being provided to the Third Party as part of your purchase of the Third Party Service. 
      3. If you do not wish for your documents and/or personal information to be provided to the third party as part of making a Third Party Purchase through our Website, then you will not be able to complete the purchase. 
      4. Once you have paid for the Third Party Service and Youdolaw has provided those documents and/or personal information to the third party, your contract with Youdolaw with respect to that Third Party Service comes to an end and we are not responsible for the Third Party Service, advice provided or any interaction that you may otherwise have with the third party, and their website, websites framed within this Website engaged a third party, Youdolaw does not in any way whatsoever take responsibility for that third parties’ advice and relationship with you. At that point you will have entered into a separate arrangement with the Third Party.   
    4. Content supplied by Third Parties:
      1. Youdolaw will allow Third Parties to advertise their goods and/or services and to upload information and other content directly to our Website for our users to access. 
      2. Youdolaw will also provide links to our users to Third Parties, including documents and information that they may provide, that may assist our users with their Divorce Document. 
      3. Youdolaw will sell products on our website which are provided by third parties, however, please be aware that we do not act as an agent for any such third parties and take no responsibility, and assume no liability, for:
        1. any advice or other services that the third party provides;
        2. any content provided by such third parties that is, or may reasonably be considered to be, abusive, harmful, obscene, indecent, harassing, inflammatory, profane, racially, violent, ethnically or otherwise objectionable, libellous, defamatory, deceptive, pornographic, sexually explicit, unlawful or plagiarised; any of the information supplied by such third parties (including opinions, ideas, photographs, comments, suggestions, observations, text, videos, data, music, sounds, chat messages, files or any other material); 
        3. and/or any loss or damage that results from any dealings that you may have with such third parties.
      4. Youdolaw does not recommend or endorse any Third Party goods or services that are listed, advertised or referred to in this Website or the content of any Third Party websites.
      5. Youdolaw may sell third party services on our website, however, we are not responsible for their content, advice provided or any interaction that you may otherwise have with the Third Party, and their website, websites framed within this Website or third party advertisements, and we do not make any representations, or provide any guarantees or warranties, regarding their content, their advice or their accuracy.   
      6. If Youdolaw refers you to a Third Party as part of your purchase of the Divorce Document or any Services that we provide, we are not responsible for the content of linked, advice provided or any interaction that you may otherwise have with the Third Party, and their website, websites framed within this Website engaged a Third Party, youdolaw does not in any way whatsoever take responsibility for that Third Parties’ advice and relationship with you. At that point you will have entered into a separate arrangement with the third party.   
      7. We are not responsible for the content of linked Third Party websites, websites framed within this Website or Third Party advertisements, and we do not make any representations, or provide any guarantees or warranties, regarding their content, their advice or their accuracy. These links may unintentionally connect with websites containing information that some users may find inappropriate or offensive. Your use of any Third Party websites is at your own risk and subject to the third party’s respective terms and conditions of use.
    5. You acknowledge that Youdolaw does not:
      1. review or take responsibility for the truth or currency of any of the material or information that Third Parties provide or make available through our Website, including content used by those Third Parties;
      2. control, endorse, approve or warrant to you the merchantability or fitness for any particular purpose of any of the goods or services of any Third Parties referred to in this Website or whose identities become known to you through this Website, including suppliers of content that is published or made available in or through this Website;
      3. offer professional advice on the quality or suitability of any goods, services or information supplied by any such Third Parties; or 
      4. endorse or recommend any Third Party supplier or any third party goods or services, including where details of the relevant supplier are provided by Youdolaw to you or otherwise become known to you through our Website.
    6. Disputes with Third Parties:
      1. You are solely responsible for your interactions with any Third Parties listed on this Website and Youdolaw is not a party to any transactions between you and those Third Parties. 
      2. We reserve the right, but have no obligation, to monitor and take action regarding any disputes between you and Third Parties.
      3. If you believe that any Third Party from which you have purchased any goods or services through this Website has failed to provide those goods or services to you, or that those goods or services did not meet your expectations, please contact us to let us know so that we may take disciplinary action against that Third Party if we consider it appropriate at our absolute discretion to do so. Youdolaw will not, however, act on behalf, or on behalf of any Third Party, in respect of any dispute between you and a Third Party.
  14. Copyright and Intellectual Property
    1. The Website, the Divorce Document, Services and all of the related products of Youdolaw are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the Divorce Document and compilation of the Website (including but not limited to text, graphics, logos, button icons, video images, audio clips, Website code, scripts, design elements and interactive features) or the Services are owned or controlled for these purposes, and are reserved by Youdolaw or its contributors.
    2. All trademarks, service marks and trade names are owned, registered and/or licensed by Youdolaw, who grants to you a worldwide, non-exclusive, royalty-free, revocable license whilst you are a Member to:
      1. use the Website pursuant to the Terms;
      2. copy and store the Website and the material contained in the Website in your device's cache memory; and
      3. print pages from the Website for your own personal and non-commercial use.

Youdolaw does not grant you any other rights whatsoever in relation to the Website, the Divorce Document or the Services. All other rights are expressly reserved by Youdolaw.

  1. Youdolaw retains all rights, title and interest in and to the Website and all related Products/Services. Nothing you do on or in relation to the Website will transfer any:
    1. business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright, or
    2. a right to use or exploit a business name, trading name, domain name, trade mark or industrial design, or
    3. a thing, system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a thing, system or process),

to you.

  1. You may not, without the prior written permission of Youdolaw and the permission of any other relevant rights owners: broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Services or third party Services for any purpose, unless otherwise provided by these Terms.       2. grant to Youdolaw a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sub-licensable and transferable license to use, reproduce, distribute, modify, adapt, prepare derivative works of, publicly display, publicly perform and otherwise exploit all or any part of that User Content in any way at Youdolaw ’s absolute discretion.
  1. Privacy
    1. Youdolaw takes your privacy seriously and any information provided through your use of the Website and/or Services are subject to Youdolaw's Privacy Policy, which is available on the Website, and which is incorporated by reference into these Terms as part of these Terms. 
  2. Security 
    1. While Stripe, our Website hosting providers, and any other Third Parties employ secure technology for transactions with our users, we will not be responsible for any damages, including Consequential Loss (whether direct or indirect), that may be suffered by a customer whose credit or debit card, bank account information or personal information is used in a fraudulent or unauthorised manner by any person other than youdolaw. 
    2. Youdolaw may request further information from you, such as a copy of your credit card and/or other identification documentation, as part of our internal validation procedures. These procedures help bank and credit card account holders from online fraud and may be used to verify that you are in fact the person the subject of the Divorce Document that is being created or Service/Product being purchsed.
    3. If further information is requested and you do not provide the requested information within such time as Youdolaw considers appropriate at its absolute discretion, your order will be cancelled and, if your payment has been received, it will be refunded back to you.
  3. General Disclaimer
    1. Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.
    2. Subject to this clause, and to the extent permitted by law:
      1. all terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded; and
      2. Youdolaw will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms (including as a result of not being able to use the Services or the late supply of the Services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.
    3. To the maximum extent permitted by law, Youdolaw and its officers, employees, agents, consultants, licensors, partners and affiliates expressly disclaim all conditions, representations and warranties (whether express or implied, statutory or otherwise) in relation to this Website and any Products/Services purchased or obtained through this Website, including any implied warranty/guarantee of merchantability, fitness for a particular purpose or non- infringement.
    4. Use of the Website and the Products/Services is at your own risk. Everything on the Website and the Products/Services is provided to you "as is" and "as available" without warranty or condition of any kind. None of the affiliates, directors, officers, employees, agents, contributors and licensors of Youdolaw make any express or implied representation or warranty or guarantee as to the reliability, timeliness, quality, suitability, truth, availability, accuracy or completeness of the  Products/Services or any products or Services (including the Products or Services of Youdolaw) referred to on the Website. This includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:
      1. failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records;
      2. the accuracy, suitability or currency of any information on the Website, the Services, or any of its Services related products (including third party material and advertisements on the Website);
      3. costs incurred as a result of you using the Website, the Services or any of the products of Youdolaw; and
      4. the Products/Services or operation in respect to links which are provided for your convenience.
    5. Youdolaw does not represent, warrant or guarantee that:
      1. the use of this Website will be secure, timely, uninterrupted or error-free or operate in combination with any other hardware, software, system or data; 
      2. this Website will meet your requirements or expectations;anything on this Website, or on any Third Party website referred or linked to in this Website, is reliable, accurate, complete or up-to-date;
      3. the quality of any Products, Services, information or other material purchased or obtained through this Website will meet any particular requirements or expectations;
      4. errors or defects will be corrected;
      5. this Website or the servers that make it available are free of viruses or other harmful components;
      6. the Divorce Document you create using this Website will be enforceable under a Court of competent jurisdiction.

    1. Youdolaw is a digital platform that enables users to prepare and generate their own Divorce Document online and file their divorce application themselves. 
    2. Youdolaw is not a law firm and is not registered or regulated by the Law Institute of Victoria and/or Victorian Legal Services Board or any other law society or institute in any other State or Territory within Australia.
    3. By creating your Divorce Document and/or purchasing our Services (including Third Party Services) and/or products or visiting out Website, you acknowledge and agree that such use or visitation does not constitute or create a solicitor-client relationship between you and Youdolaw or any of its officers, employees, agents, consultants, licensors, partners and affiliates.To the maximum extent permitted by law, Youdolaw does not accept any responsibility whatsoever to you if your Divorce Document, or the Services or Products you have purchased via our Website (including Third Party Services) are not legally correct or sufficient for your personal circumstances and does not verify:
      1. your identity;
      2. your mental and/or testamentary capacity;
      3. whether you were subject to any undue influence and/or duress when visiting our Website, using our Services or signing your Divorce Document;
      4. whether you were aware of, understood the content of, and approved your Divorce Document prior to signing.
    4. There may be changes in the future to laws and/or regulations that may affect your Divorce Document, resulting in the documents being out of date or obsolete. Youdolaw cannot guarantee that the Divorce Document that you prepare via Youdolaw will always be up to date, accurate and complete.
    5. By creating your Divorce Document and/or purchasing our Services (including Third Party Services) or products, or visiting our Website, you acknowledge and agree that you have not obtained any legal advice whatsoever from Youdolaw, including its officers, employees, agents, consultants, licensors, partners and affiliates, and that you have conducted your own investigations to ensure that our Services and products meet your specific requirements. If you are unsure of or unclear about the content of our Website, the creation of your Divorce Document, or the use of our Services (including Third Party Services) or products in any respect, you should seek independent legal advice from a qualified legal professional.

The information contained on our Website and within your Divorce Document (together with any Guidance Notes, Signing Notes and Exclusions), is provided to assist you with the preparation of your Divorce Document and does not constitute the provision of legal advice. Such information is provided as general legal information only, and we strongly encourage you to seek independent legal advice from a qualified legal professional if you have any queries or concerns whatsoever, or you are simply unsure about anything contained in these documents. Youdolaw bears no liability for the provision of such information, or for the enforceability of your Divorce Document.
  5. Limitation of liability & Release
    1. Youdolaw's total liability arising out of or in connection with the Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Services to you.
    2. You expressly understand and agree that to the maximum extent permitted by law, Youdolaw, its affiliates, employees, officers, consultants, partners, licensors, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.
    3. To the maximum extent permitted by law, Youdolaw and its officers, employees, agents, consultants, licensors, partners and affiliates expressly limit their liability for breach of any non-excludable condition or warranty/guarantee implied by virtue of any legislation to the amount you have paid for your Divorce Document, and/or the Service or Product.
    4. You agree that your use of this Website is at your own discretion and risk. You agree to release Youdolaw and its officers, employees, agents, consultants, licensors, partners and affiliates from any claim, demand or cause of action that you may have against any of them arising from these Terms or the use of this Website by you or any other person. Youdolaw may plead this release as a bar and complete defence to any claims or proceedings.
  6. Termination of Contract & Breach
    1. The Terms will continue to apply until terminated by either you or by Youdolaw as set out below.
    2. If you want to terminate the Terms, you may do so by:
      1. providing Youdolaw with 30 days' notice of your intention to terminate; and 
      2. closing your accounts for all of the services which you use, where Youdolaw has made this option available to you. 

Your notice should be sent, in writing, to Youdolaw via email to the email address used to register your account.

  1. Youdolaw may at any time, terminate the Terms with you if:
    1. you have breached any provision of the Terms or intend to breach any provision;
    2. Youdolaw is required to do so by law;
    3. the provision of the Services to you by Youdolaw is, in the opinion of Youdolaw, no longer commercially viable. 
  2. Subject to local applicable laws, Youdolaw reserves the right to discontinue or cancel your membership at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Products/Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts Youdolaw's name or reputation or violates the rights of those of another party.
  3. Youdolaw retains the right, without limitation to any other remedies available to it at law or in equity, to suspend or terminate your access (either indefinitely or temporarily), without notice, to this Website, your Account or to refuse to provide any Services that Youdolaw provides to you.
  4. Youdolaw retains this right in circumstances where:
    1. You have breached these Terms in anyway whatsoever;
    2. Youdolaw is unable to verify or authenticate any information that you provide to us; and/or
    3. Youdolaw considers that your use of this Website or any other actions you may cause damage and/or legal liability to Youdolaw, any of its customers or suppliers or any other person.
    4. Youdolaw may (at its absolute and sole discretion) also remove or block your access to any information and/or materials (in whole or in part) that Youdolaw, believes is in any way offensive or in violation of any applicable law, any person’s intellectual property rights or these Terms.

    1. You agree to indemnify  Youdolaw, its affiliates, employees, agents, contributors, consultants, officers, affiliates, third party content providers and licensors from and against:
      1. all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with your content;
      2. any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so; and/or
      3. any breach of the Term; and
      4. suffered or incurred by any of them due to, arising out of, or in any way related to (directly or indirectly):
        1. any information or content that you submit, publish, transmit, or otherwise make available through this Website;
        2. any claim arising out of your use of and/or access to a third-party website;
        3. your negligence or misconduct, breach of these Terms or any law or any violation of any rights of any person or third party;

        5. any claim filed by a third party, including but not limited to, any claim arising from your use of the Divorce Document or our Services, and/or the legality of your Divorce Document.
  2. Force majeure
    1. To the maximum extent permitted by law, and without limiting any other provision of these Terms, Youdolaw excludes liability for any delay in performing any of its obligations under these Terms where such delay is caused by circumstances beyond the reasonable control of Youdolaw, and Youdolaw shall be entitled to a reasonable extension of time for the performance of such obligations.
  3. Interruptions
    1. While Youdolaw endeavours to ensure this Website and the Products/Services provided are operational, there are times when there could be unexpected interruptions, which may be temporary, including for the purposes of maintenance for example or addressing technical difficulties, testing, and updating the Website to reflect any variations to the law or regulatory requirements.
    2. Youdolaw, reserves the right, at any time to modify or discontinue, either temporarily or permanently, any functions and features of this Website and/or the products and/or Services, without any liability to you.
  4. Venue and Jurisdiction
    1. The Products/Services offered by Youdolaw is intended to be viewed by residents of Australia. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Victoria, Australia.
  5. Governing Law
    1. The Terms are governed by the laws of Victoria, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of Victoria, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.
  6. Independent Legal Advice
    1. Both parties confirm and declare that the provisions of the Terms are fair and reasonable and both parties having taken the opportunity to obtain independent legal advice and declare the Terms are not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.
  7. Severance
    1. If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.

      1. In these Terms, the following rules of interpretation apply unless the context requires otherwise:
        1. headings are for reference purposes only and in no way define, limit or describe the scope or extent of any provision in these Terms;
        2. where any word or phrase is defined, any other part of speech or other grammatical form of that word or phrase has a cognate meaning;a reference to a document (including these Terms is a reference to that document (including any schedules and annexures) as amended, consolidated, supplemented, novated or replaced;an expression importing a natural person includes any individual, corporation or other body corporate, partnership, trust or association and any governmental agency and that person's personal representatives, successors, permitted assigns, substitutes, executors and administrators; a reference to writing includes any communication sent by post, facsimile or email;
        3. a reference to time refers to time in Melbourne, Victoria and time is of the essence;
        4. all monetary amounts are in Australian currency;
        5. The word “month” means calendar month and the word “year” means 12 calendar months;the meaning of general words is not limited by specific examples introduced by “include”, “includes”, "including", "for example", "in particular", “such as” or similar expressions;a reference to a “party” is a reference to a party to these Terms, and a reference to a “third party” is a reference to a person that is not a party to these Terms;
        6. a reference to any thing is a reference to the whole and each part of it;
        7. a reference to a group of persons is a reference to all of them collectively and to each of them individually;
        8. words in the singular include the plural and vice versa; anda reference to one gender includes a reference to the other genders. 
    2. Notifications 
      1. Youdolaw may provide any notification for the purposes of these Terms by email. 
    3. Costs 
      1. Except as specifically provided in these Terms each party must bear its own legal, accounting and other costs associated with these Terms.
      2. In the event that you are required at any time to provide information to a third party (including by way of a court order, or for mediation or arbitration purposes), and youdolaw is required to assist in the provision of such information, you acknowledge and agree that youdolaw shall be paid its reasonable costs and expenses incurred in assisting with the extraction and provision of such information to you and/or a Third Party. 
    4. Assignment  
      1. You may not assign, transfer or sub-contract any of your rights or obligations under these T&Cs without youdolaw 's prior written consent.Youdolaw may assign, transfer or sub-contract any of its rights or obligations under these Terms at any time without notice to you. 
    5. No waiver 
      1. Waiver of any power or right under these Terms must be in writing signed by the party entitled to the benefit of that power or right and is effective only to the extent set out in that written waiver. Any failure by youdolaw to act with respect to a breach by you or others does not waive youdolaw 's right to act with respect to that breach or any subsequent or similar breaches. 
    6. Severability 
      1. The provisions of these Terms are severable and, if any provision of these Terms is held to be illegal, invalid or unenforceable under present or future law, such provision may be removed and the remaining provisions shall be enforced. 
    7. Variation 
      1. Youdolaw reserves the right to:
        1. amend these Terms and any other policy or information contained on this Website at any time in its sole discretion and any such changes will, unless otherwise noted, be effective immediately;
        2. make changes to the Services and/or Products, including any fee charged for the for the Services and Products that we provide;
        3. make updates to reflect changes in any relevant laws and/or regulatory requirements; andimplement improvements and/or technical adjustments.
      2. You may only vary or amend these Terms by written agreement with Youdolaw. 
      3. Your continued usage of this Website will mean you accept those amendments.

We reserve the right, without notice and at our sole discretion, to change, suspend, discontinue or impose limits on any aspect or content of this Website or the Products/Services offered through this Website, including to suspend and/or cancel your Account in circumstances where, Youdolaw in its absolute discretion, determines that such suspension or cancellation is warranted.
    8. Definitions
      1. Account means your online account opened with Youdolaw using this Website for the purposes of using purchasing our products and using our Services.
      2. Business Day means a day (other than Saturday, Sunday or public holiday) when banks in Victoria are open for business. 
      3. Consequential Loss means any loss, damage or expense recoverable at law:
        1. Other than a loss, damage or expense that would be suffered or incurred by any person in a similar situation to the person suffering or incurring the loss, damage or expense; or
        2. which is a loss of: 
          1. opportunity or goodwill;
          2. profits, anticipated savings or business; 
          3. data; or 
          4. value of any equipment.
        3. and any costs, including legal costs, or expenses incurred in connection with the foregoing.
      4. Divorce Document includes, but is not limited to the following documents generated through the Youdolaw Website, namely:
        1. The “do it yourself” media provided on our Website teaching you how to complete the divorce application yourself and all other related content regarding the divorce application process; and
        2. the following Court document templates:
          1. Response to Divorce Application;
          2. Affidavit of Service (by hand/process server);
          3. Affidavit of Service (by post);
          4. Affidavit (living under the same roof);
          5. Corroborating Affidavit (living under the same roof);
          6. Affidavit – translation of marriage certificate;Affidavit – proof of signature;
          7. Application for reduction of Court filing fee – general;
          8. Application for reduction of Court filing fee – financial hardship; and
          9. any other Court document templates that are sold on our Website. 
      5. Privacy Policy means the privacy Policy found on our Website located at Privacy Policy page
      6. Services and Products means the Youdolaw services and products provided on our Website including:
        1. the interactive features and content to create, update, revise and approve your Divorce Document; 
        2. any other content, products or services (including Third Party Services) that may be added to our Website from time to time; and
      7. “you”, “your”, “yours”, “user” or “customer” means anyone who accesses our Web Page and creates an Account.
  9. Prohibited conduct
    1. You must not:
